Regulatory changes, deadlines falling due and notes on intellectual property and artificial intelligence in Argentina.

Unpublished works on deposit are destroyed if not renewed

Deposit in custody of an unpublished work before the Argentine National Copyright Office protects for three years. Once that term expires there are thirty days to renew it.

If it is not renewed, the Office destroys the deposited work. Anyone who deposited software or a manuscript and lost track of the date may have lost that evidence without noticing. Deposits made before 2023 are worth reviewing.

The declaration of use that leaves trademarks exposed

Between the fifth and sixth year from grant, a mid-term declaration of use must be filed. It is a short procedure, and the one that leaves the most registrations vulnerable through oversight.

If it is not filed, the mark is presumed unused and any third party may seek its cancellation. If you hold marks granted between 2020 and 2021, now is the time to check.
